Blake Lively Facing ANOTHER Legal Battle – Her Beauty Brand Is Going After A Small Business!

Blake Lively must just really like to be in court or something.

Amid her ongoing and increasingly contentious lawsuit against It Ends With Us costar Justin Baldoni, the Gossip Girl alum is at it again! According to a Friday report from DailyMail.com, the holding company which owns the 37-year-old actress’ beauty brand Blake Brown has filed suit against a small business!

That outlet reports the target of the powerful Hollywood A-lister’s lawsuit is a woman named Kimberlie Hamner. Poor ol’ Kimberlie apparently owns a small business (and a granted trademark!!!) called Beauty by Blake.

However, Lively’s holding company Family Hive LLC also owns at least three trademark filings associated with Blake Brown, per the DM — one for its name, one for its beehive-shaped logo, and a third for a logo-name combo. And as it turns out, Family Hive is PISSED that Hamner’s beauty brand comes close to Lively’s name!

As the reporting goes, Hamner is a 27-year-old entrepreneur from Utah. Last September, she filed an application with the Trademark Official Gazette for the “Beauty by Blake” biz name. Specifically in her filings, Hamner was hoping to trademark a line of cosmetic oils and “serums for cosmetic purposes.”

Well, back in April, the Trademark Official Gazette published her trademark. Big win, right? Maybe not! Last Thursday, Family Hive officially filed suit in opposition to the move.

Per legal papers seen by DM, Lively’s holding company stated its grounds for opposition to Hamner’s push for a trademark were due to “priority and likelihood of confusion” that would “likely cause damage” to their trademark. In the filing, attorney Leo M. Loughlin argued this about Hamner’s Beauty by Blake brand:

“[It] is likely to be confused, to be deceived, and to assume erroneously that Applicant’s goods are those of Family Hive or that Applicant is in some way connected with or sponsored by or affiliated with Family Hive.”

Loughlin further argued that the Utah-based entrepreneur has “no connection whatsoever with Family Hive and no permission or license” the name.

Hmmm…

Soooo what is this all about, that no one can use the name “Blake” for anything anymore because it might get confused with the A-list actress? Is that really the argument here???

If so, well, does actor Blake Anderson know this? How about country music singer Blake Shelton?! And former Cincinnati Bengals quarterback Jeff Blake?!?! LOLz. But seriously, you get the point. Is this really what Lively’s legal side is doing at this point?!?!
